This regulatory position statement (RPS) does not change your legal requirement to take all reasonable steps to avoid contaminating other waste with POPs when you shred waste upholstered domestic seating at a waste treatment site.
It allows you to shred waste upholstered domestic seating at permitted sites while you design and fit equipment to abate emissions to plant or buildings. You must install and commission these abatement measures by 1 December 2024.
However, the Environment Agency will not normally take enforcement action for not keeping to this legal requirement when shredding waste upholstered domestic seating if you comply with the requirements in this RPS.
This enforcement position does not apply to any other legal requirements.
