Asylum Support Tribunal decision of Judge Verity Smith on 31 July 2014.

Discontinuance of support under Section 95 on the grounds of the appellant’s purported breach of the conditions of her support. Held that it was accepted by both parties that there could be a serious prejudice to the appellant’s criminal proceedings if the AST found against the appellant. The appeal was remitted for the respondent to make a duly considered decision on the appellant’s eligibility for support once her criminal proceedings had been disposed of. At that time both parties would be able to provide evidence of any barriers or none to the appellant’s return to Uganda.
